TM USE INVESTIGATION

It is often essential to establish facts surrounding the use or non use of a Trade Mark, how it is used, in what markets, the extent of its reputation, etc. In the event of non-use, is the mark vulnerable to cancellation proceedings, if not, can it be acquired. All of these aspects are considered during the investigation and are reported accordingly with the relevant observations and recommendation.

National TMs

Probe provides TM use reports on a country-by-country basis throughout the EU and the rest of Europe, Asia-Pacific and the Americas.

International Registrations

The scope of MP registrations is ever increasing. Probe has the resources and experienced staff to be able to provide TM investigative services in all international jurisdictions.

CTM

There is a pronounced upward trend in opposition actions.  In these circumstances an investigation of the opponent company to determine its size, reputation, market presence and the scope and extent of use (if any) of their Trade Marks can provide valuable background information to assist in countering such an action or to assist in the negotiation of a co-existence agreement.

Probe is increasingly finding CTMs that are vulnerable to cancellation proceedings.  This background information can allow the client to proceed with confidence with the registration of their own marks knowing that they are not vulnerable to opposition proceedings.

Brand Clearance & Research

Market research is an essential exercise prior to the launch of new brands and trade marks.  Probe offers a comprehensive service to identify and report in depth on potential problems.

Market surveys are often useful prior to entering into any acquisition of an existing brand or launch of any new brand.  Probe provides a comprehensive survey service.

TM Infringement

In the event that a Trade Mark is being infringed or otherwise used in an unauthorised manner by a third party. The main thrust of our investigation is to identify who they are, their business activities and where they operate from, with a view to providing information and evidence in support of legal proceedings.
